Terms and Conditions
These Terms and Conditions are applicable every time you access our website and/or order goods from our website. Before proceeding with an order you will be required to show that you have read and understood the following terms and conditions. We recommend that you print a copy of these Terms and Conditions for your future reference.
Ownership - This site is owned and operated by Out of Your Shell Limited T/A Chilled Turtle PO Box 2152, Shoreham-by-Sea, BN43 9DB. - All rights in this website are owned by us. Any unauthorised use, copying or modification is prohibited without prior request and our consent granted by us in writing.
Ordering Goods - All orders placed through our website will be subject to our acceptance of the order. - When you submit an order to us on our website you will receive an email confirming that we are processing your order. You will then receive a second email from us acknowledging your order and giving you estimated timescales for delivery. You should check both emails for accuracy and let us know immediately if there are any errors. Neither of these emails constitute acceptance of the order by us. Your order will be accepted (and a contract will then be formed between us) when we dispatch the goods to you. Title to the goods will pass to you on delivery. - Where you have redeemed a promotional code or any other offer ("a Code") against your order, acceptance of this order is subject to our verifying that the Code has been issued to you personally, that you comply with all the terms of the offer and qualify for the Code. In the event that the Code has not been issued to you for your personal use or you do not qualify for the offer, the price of the order will be adjusted notwithstanding any email or other confirmation that you receive. - Should you wish to cancel your order or return any goods, please go to the Returns section for further information.
Processing your orders and payment - Whilst it is our intention to keep our website up to date and error free, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled. - All prices shown on our website are inclusive of VAT. Delivery charges are clearly highlighted in the checkout section. - Some postal addresses in Northern Ireland, some offshore islands and some remote areas of Great Britain may not be covered by our delivery services and we may not be able to arrange delivery of some items to such addresses. You will be notified of this when you place your order. - Whilst we make every effort to deliver goods on the day we specify, we cannot guarantee delivery on that day or accept liability for deliveries made outside this timescale. We cannot accept liability for out of pocket expenses or other costs incurred due to failed or delayed deliveries. - All items are subject to stock availability. - When we deliver your items you may be asked to sign for the goods to acknowledge that you have received them. - Please note that if you wish to return goods under our Approval guarantee, you have 10 days from receipt of the goods to return them to us. Chilled Turtle Returns Policy We love our products and we care that you are happy with your purchase. We would like you to please read the following Chilled Turtle policies so you are just as happy with our procedures as we are.
Returns If you are not happy with the product or products you receive we do offer a full refund or exchange to the equivalent value. This is guaranteed for Customers returning products within 10 days of delivery having purchased Chilled Turtle products through one of our purchase facilities. We would like you to follow the returns procedure below to ensure we can act quickly and deal with your returns promptly.
All items, the returns procedure - All items must be returned by recorded delivery marked for the attention of our returns department to: Chilled Turtle Returns, PO Box 2152, Shoreham-by-Sea, BN43 9DB - You must include your name and full contact details so we can talk to you about the return. - If you can include your original order paperwork, this will help us to deal promptly with your return. - All goods must be returned in the original packaging with all tags in place, in a good considered re-saleable condition. - We will not accept responsibility for lost parcels or postal charges incurred when returning goods. - We reserve the right to refuse exchange or refund, if we consider the products have not been treated in accordance with our label or website instructions.
Faults If you feel there is a fault with your Chilled Turtle products we will offer a full refund or, if you prefer, exchange to the same product. This is subject to stock availability or to the equal value of the goods. This is guaranteed for customers returning our products bought through one of our purchase facilities. We will need you to follow the faulty returns procedure below and return the goods with a proven fault within 10 days of purchase or delivery.
All items, the faulty returns procedure - All items must be returned by recorded delivery marked for the attention of our returns department to: Chilled Turtle Faulty Returns PO Box 2152, Shoreham-by-Sea, BN43 9DB - You must include your name and full contact details so that we can contact you if we need to talk to you about the faulty return. - If you can include your original order paperwork, this will help us to deal promptly with your faulty return. - All goods must be returned in the original packaging with all tags in place and clearly stating what you feel the fault is. - We will not accept responsibility for lost parcels or postal charges incurred when returning goods. - We reserve the right to refuse exchange or refund, if we consider the products have not been treated in accordance with our label or website instructions regarding wash and care for our products.
Notes: You must take reasonable care of the goods and immediately return them to us in the above way. We will not consider that you have taken reasonable care of the goods if they have been used in a way or to an extent beyond what would be considered reasonable.

We at Chilled Turtle believe in offering an excellent level of Customer Care and want to deal with any queries you have quickly and effectively. - If you prefer to email us, you can do so at hello@chilledturtle.com, please mark the email subject with your query, for example 'returns'.
Can I cancel my order? If so, how do I cancel my order? For most items, you have the legal right to cancel your order within 7 working days of receiving the goods. However, this right does not apply to certain items such as personalised products. If you wish to cancel using this right, you need to inform us in writing within 7 working days starting the day after you received the goods. You must take reasonable care of the goods and immediately return them to us in the normal way. We will not consider that you have taken reasonable care of the goods if they have been used in a way or to an extent beyond what would be reasonable when examining the goods in a shop before purchase.
What are unacceptable returns? If you return an item to us outside the terms of our returns policy your statutory rights do not apply and we may not refund you. The item may be returned back to you at your expense. You will be notified of this and other associated charges. If you send the item back to us again, or refuse to accept delivery, this will be deemed to be an irreversible instruction for us to dispose** of your goods without further notice.
**Please note: Disposal will not constitute any admission on our part that we have failed in any way to honour our obligations to you in full and will not constitute any unlawful action against the goods.

General - The use of our site and any contracts formed are governed by English law. - All products are sold on the basis that they are for personal, domestic use only. - We shall not be responsible to you whether in contract, tort (including negligence) or otherwise for incidental, special, indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection of the performance or non performance of our obligations under these terms and conditions including such damage as may be reasonably foreseeable at the date you order the goods. - Nothing in these terms and conditions shall exclude or restrict our liability for death or personal injury caused by our negligence. - Our liability for any claim for loss or damage shall be limited to the sum paid by you for the goods. - A person who is not a party to these terms and conditions shall have no right to enforce any term under the Contracts (Rights of Third Parties) Act 1999. - If any provision of these terms and conditions is found to be invalid or unenforceable by a court the invalidity or unenforceable of such provision shall not affect the other provisions of these terms and conditions. - We may assign or transfer any of our rights or sub contract any of our obligations under these terms and conditions to any third party. - You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with our specific permission in writing. - We reserve the right to change these terms and conditions from time to time and any such changes will be communicated on our website. - There are links on our website to third party websites which we believe may be of interest to you. We do not have any control over the content of these websites nor can we be liable in respect of anything contained on these websites. - These terms and conditions govern the entire trading relationship between you and ourselves and will remain in force for the duration of our trading relationship. - All intellectual property rights (including use of trade marks) shall be solely owned by us. You are permitted only to use material on this website as expressly authorised by us or our licensees. - Any unauthorised use of material on this site is strictly prohibited. - We will use reasonable endeavours to verify the accuracy of any product or pricing information which we place on the site but we make no warranties (whether express or implied) in relation to the accuracy of such information). - We may close your account or terminate our trading relationship by giving you notice of at least seven (7) days. This does not affect your obligation to repay any amounts you owe to us.
Key Information Default Charges: charges are payable by the customer in respect of the following matters: - The customer going into payment arrears - Failure of the customer to respond to an arrears collection communication - Any dishonoured cheque or missed direct debit payment by the customer - The creditor agreeing to a reduced payment schedule with the customer - Transfer of the customer's debt to a debt collection agency - Failure of the customer to provide a forwarding address to the creditor - Any court costs and fees incurred by the creditor in pursuit of arrears
